About

This Legal Aspects of Sport Management Course Guide was created to assist patrons locate resources pertaining to the Health and Human Performance course 3050 Legal Aspects of Sport Management.  This is by no means an exhaustive listing of all resources available within UW Platteville Library System.  Click on one of the tabs at the top of this guide to access helpful links to useful information available in electronic databases, online resources, print resources, visual resources such as movies, and professional organizations.  If you need any assistance please contact me.

Starting a new search for any topic can be overwhelming, however, it really does not have to be!  When searching the topic Legal Aspects of Sport Management think of the different aspects of the subject: sports, labor relations, law, business, and sometimes medicine.  Other places to find keywords are databases, articles, and your syllabus, look at the areas you will be studying, topics of discussion, and the sports themselves.  When breaking the larger subject down it will be easier to focus your research and find the materials you are truly looking for.  Please do not forget, when all else fails, ask the librarian.

Key Definitions

Tort -- A civil wrong or injury that often results in monetary damages.

Product Liability -- Liability attached to the manufacture or distribution of a product.

Risk Management -- The process of reducing or eliminating the risk of harm to participants and loss to an organization through injury and subsequent lawsuits.

Agency Law -- The law that applies to an explains the relationship between principal and agent. Agency law specifically defines the rights and responsibilities of both principals and agents, the authority of the agent as he or she works for the principal, and the creation of the agency relationship itself.

Contract Law -- Defined by a contract, the elements of a contract, and some typical provisions that can be found in all contracts.  Contract law is often understood by reference to the Restatement of the Law.  Bilateral Contract -- Contract that contains two promises: the offer and the acceptance.

Employment Law -- Employment at Will -- A legal doctrine that holds that the employment relationship can end at any time and for any reason. Important exceptions to this doctrine are public policy, implied contracts, and the application of federal laws such as those governing discrimination.

Constitutional Law -- The law relevant to the Constitution of the United States and to state constitutions.

Gender Equality -- Equal Work -- The concept that individuals of either sex must be paid similar wages for jobs that are substantially equal, although the skill, effort, and responsibility of the jobs need not be identical.  The jobs must be substantially equal except for the fact that one employee is paid higher wages.  Equal Protection -- A guarantee that laws will be applied in an equal and nondiscriminatory manner.

Intellectual Property Law -- Laws pertaining to Copyright and Trademarked materials.  Copyright -- A right granted by statute to the author or creator of a literary or artistic production that provides the author with the exclusive right to reproduce, publish, or sell the production.  Trademark -- Any word, name, symbol, or device that an organization uses to identify and distinguish its services from the services of another organization and to indicate the source of the service.

Antitrust Law -- Laws which are implemented to promote competition and efficiency int eh marketplace and to protect consumers form the growing monopoly power of big business.  Antitrust laws were established to maintain a high degree of competition among producers so consumers have access to affordable and reasonably priced products.

Labor Law -- Laws that regulate the employer-employee relationship, and can include Labor Unions.  Union -- An organized group of employees that uses their collective strength to protect the rights and interest of the group's members. One way that unions accomplish this is by members' engagement in collective bargaining-through the representation of union leaders-with their employer on matters affecting them, such as wages, hours, and conditions of employment.

Course Description

This course is designed to learn many legal concepts and risk management for future professionals in a sport or recreation setting. Students will learn the liability and safety concerns for participants and spectators and learn skills, roles and functions that are important for a person who wants to work in the sports industry.

Gain real-world experience
Internships across the state or country provide innovative hands-on experience. Some of our students have interned at Grant Regional Hospital's Cardiac Rehab Services, University of Wisconsin Strength and Conditioning, Stonehill Wellness, in Germany for the American Football Team Fürstenfeldbruck "Fursty" Razorbacks, Northrop Grumman Corp., and Get Fast Inc., Chicago.
Student Teaching
Teach during your final semester in Wisconsin, Illinois, Iowa, Minnesota, and more if you choose the physical education emphasis. You might also be able to teach in Germany or England.
